This document is a working draft, pending review by Australian counsel and by Allure's insurer, and is not yet in force. It is published here for transparency. When Allure runs ticketed events, you will be asked to agree to the final version at the time of booking and again at check-in. Questions: allure@allureaus.com.
1. What this is
This document governs your attendance at any Allure event — a party, gathering or function organised or hosted by [OWNER FULL LEGAL NAME] trading as Allure Members Club (ABN [ABN]) ("Allure", "we", "us", "our"), whether the event is at a hired venue, a licensed venue, or a private residence.
You agree to these Event Terms when you obtain a ticket, place or RSVP for an event, and again when you check in at the event.
These Event Terms are in addition to the Terms of Membership and Use and the Community Guidelines. If there is any inconsistency about a particular event, these Event Terms prevail for that event. Any written event-specific terms sent with your invitation (dress code, theme, arrival times, ratios) also apply.
Please read clauses 7, 8, 11 and 12 carefully. They describe risks you accept by attending, and they limit and exclude some of our liability to you, to the extent the law allows.
2. Who can attend
- Attendance is limited to current Allure members aged 18 or over. Bring nobody who is not a booked, checked-in member.
- You must bring government-issued photo identification and present it at check-in if asked. Entry is refused if age or identity cannot be verified.
- Entry is refused, with no refund, if on arrival you are intoxicated or affected by drugs, or are behaving in a way that a host or security reasonably considers unsafe.
- Your ticket or place is personal to you and is not transferable without our prior written approval.
3. Tickets, ratios and admission
- Events may use ticket types — for example Couple, Single Female, or Single Male (with prior approval) — to manage the balance of the room. If you buy a ticket type you are not eligible for, or a "single" ticket that required approval you did not obtain, the ticket may be cancelled and refunded less a reasonable administration fee.
- Dress code, theme, capacity and arrival cut-off times are set for each event and are told to you in advance. Arriving after the admission cut-off may mean you are not admitted, with no refund.
- Admission is subject to a condition of entry search: by entering you agree that a host or security may inspect your bag and outer clothing for prohibited items (weapons, illegal drugs, recording devices, glass brought from outside, or anything else prohibited for that event). You may decline, in which case entry is refused without refund.
- We may operate a wristband, stamp or sign-in system. You must keep and show it on request.
4. The venue location
The venue address is confidential and is usually released only to confirmed attendees, shortly before the event. You must not share, post, forward or publish the address, or photographs or video of the venue or its attendees, at any time. This is a condition of your ticket and a Community Guidelines obligation.
5. Refunds, transfers and cancellations
Unless the invitation states a different policy for a specific event:
| When you tell us you cannot attend | What you get |
| More than 7 days before the event | Full refund, or a transferable credit — your choice — less any non-refundable third-party cost already incurred for you (for example a caterer deposit or a per-head venue charge). |
| 7 days to 24 hours before the event | Transferable credit only. |
| Less than 24 hours before the event | No refund or credit. |
| No-show, or arrival after the admission cut-off | No refund or credit. |
| Entry refused or removal from the event for a reason in clause 2, 3, 6, 9 or the Community Guidelines (including intoxication) | No refund or credit. |
| Allure revokes your membership before the event, for a reason unrelated to your conduct at that event | Full refund of the ticket price. |
If Allure cancels or materially reschedules an event, you get a full refund of the ticket price (or, if you prefer, a credit). We are not responsible for other costs you arranged yourself, such as travel or accommodation.
Nothing in this clause limits your rights under the Australian Consumer Law (the "ACL"), including the consumer guarantees, which cannot be excluded. If a consumer guarantee applies and we fail to meet it, you may be entitled to a remedy under the ACL regardless of the table above.
6. Alcohol
How alcohol is handled depends on the event. The invitation tells you which of these applies:
(a) Events where Allure holds the licence and runs the bar
Alcohol is served by staff who hold a current NSW Responsible Service of Alcohol competency. In line with the Liquor Act 2007 (NSW): alcohol is not served to anyone who is intoxicated, or to any minor (and no minors are admitted in any case); staff and security may refuse service, require a person to stop drinking, or require a person to leave, and may refuse entry to someone who is intoxicated; we keep an incident register; and free drinking water is always available.
(b) Events held under a venue's own licence
The venue's licensee is responsible for the service of alcohol and the venue's own conditions of entry and licence conditions apply in addition to these Event Terms. Allure defers to the licensee and its staff on all liquor matters.
(c) Unlicensed, BYO or alcohol-free events
The invitation states whether you may bring your own alcohol and any limits. Where alcohol is not sold, it is not "supplied" by Allure.
In every case, how much you drink is your responsibility. Being refused entry or removed because you are intoxicated does not entitle you to a refund.
7. The event environment — what you are agreeing to be present for
Allure events are adult social events. Depending on the event, and as described in the invitation, an event may include:
- attendees who are partially or fully undressed;
- sexually expressive performance, dancing or entertainment;
- lingerie, fetish or kink dress codes;
- rooms, areas or equipment (such as beds, slings or play furniture) provided for consensual adult activity; and
- spaces in which consensual sexual activity between attendees may take place in view of others.
By obtaining a ticket and by entering, you acknowledge that you want to be present in that environment, you accept being exposed to it, and you accept the social, emotional and physical responses it may produce in you. If you do not consent to that environment, do not attend.
You are responsible for your own boundaries, your own choices, your own sexual health (including bringing and using any protection you want to use), and for telling a host if you feel unsafe or unwell.
Nothing about the environment changes the consent rules in clause 9. Being present at an event, wearing particular clothing, entering a play area, or having consented earlier is never consent to any specific contact.
8. Assumption of risk and risk warning
8.1 Inherent risks
You acknowledge that attending an Allure event has inherent risks that cannot be entirely removed, including:
- the conduct of other attendees, which we do not control;
- slips, trips and falls, and contact with fixtures, furniture, equipment, other people or the floor, including in low light;
- the use of play equipment;
- exposure to an environment that some people find confronting;
- physical exertion, dehydration, or the effects of alcohol or other substances that a person chooses to consume;
- exposure to sexually transmitted infections arising from a person's own choices about sexual activity; and
- the risk of emotional or psychological distress.
8.2 Risk warning (Civil Liability Act 2002 (NSW), section 5M)
Warning under the Civil Liability Act 2002 (NSW). An Allure event is a recreational activity, and some elements of it (including the use of play equipment and consensual physical activity between attendees) may be a dangerous recreational activity. Allure gives you this risk warning: attending an Allure event, and taking part in any activity at it, involves risks to your physical and psychological safety — including the risks in clause 8.1 — which may result in personal injury, illness, psychological harm or, in a worst case, death. Allure does not guarantee your safety. You participate at your own risk.
8.3 What you accept
To the extent the law allows, you accept these risks and you take part in Allure events and activities voluntarily and in reliance on your own judgement.
9. Consent at events
- Consent is an enthusiastic, present "yes". It is specific to the act and the person. It can be withdrawn at any time, without explanation.
- "No", "stop", pulling away, going still or leaving all mean stop — immediately.
- A person who is heavily affected by alcohol or other drugs, asleep or otherwise unable to make a clear decision cannot consent.
- No pressure, persistence, guilting or trading of any kind.
- If you are unsure whether you have consent, you do not have it.
- If you see something wrong, or feel unsafe, go to a host — every event has a designated safety contact, identified at check-in.
A breach of consent results in immediate removal without refund and permanent revocation of membership, and a report to police where we are required to make one or believe it is right to.
10. Photography and recording
- Phones and cameras are put away in play areas and anywhere people are undressed or intimate.
- Any photograph or recording requires the enthusiastic consent of everyone identifiable in it and a host's approval.
- Breaching this is grounds for removal without refund, and may also be a criminal offence (see the Community Guidelines, clause 6).
11. Security, directions and removal
- Some events have licensed crowd controllers engaged through a licensed security firm. At all events there are hosts with authority to manage the event and a designated safety contact.
- You must comply with the reasonable directions of hosts, safety staff, security, and (at a licensed venue) the venue's staff — including directions to leave an area, to stop an activity, to hand over a prohibited item, or to leave the event.
- We may refuse entry to, or remove, any person who breaches these Event Terms, the Community Guidelines or the Terms of Membership and Use, who does not follow a reasonable direction, who is intoxicated or affected by drugs, or whose behaviour we reasonably consider puts another person's safety, dignity or privacy at risk.
- Removal for any of these reasons carries no refund, and you must leave the vicinity of the venue promptly and safely.
12. Release and limitation of liability
This clause does not exclude, restrict or modify any right or remedy you have that cannot lawfully be excluded, restricted or modified — including the consumer guarantees under the ACL, and any liability for personal injury or death that arises from reckless conduct, or that the Civil Liability Act 2002 (NSW) or other law does not permit to be excluded. It does not apply to loss caused by Allure's own negligence to the extent the law preserves that liability. Nothing in it affects any liability that results from a contravention of a written law that establishes practices or procedures for personal safety.
Subject to that, and to the maximum extent permitted by law:
- (a) Recreational services waiver. You agree that, under section 139A of the ACL and sections 5M and 5N of the Civil Liability Act 2002 (NSW), the consumer guarantees and any implied warranty that recreational services will be supplied with due care and skill are excluded in respect of any personal injury or death suffered in connection with an Allure event, to the extent those provisions allow that exclusion.
- (b) Release for inherent risks and the conduct of others. You release Allure, and our employees, contractors, hosts, peer reviewers, and (where they are not the licensee or occupier) the venue, from liability for any loss, damage, injury (including psychological injury) or death that results from an inherent risk of the event as described in clause 8, or from the conduct of another attendee.
- (c) Consequential loss. We are not liable for any indirect or consequential loss, or for loss of profit, opportunity or enjoyment.
- (d) Cap. Where our liability to you in connection with an event is not excluded but can be limited, it is limited in aggregate to the price you paid for your ticket or place, or AUD $[AMOUNT], whichever is greater.
13. Indemnity
You agree to indemnify Allure and our employees, contractors and hosts against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from:
- your breach of these Event Terms, the Community Guidelines, or the Terms of Membership and Use;
- your conduct at, or on the way to or from, an event;
- damage you cause to a venue, its fixtures or its equipment; or
- a claim brought against Allure by a third party as a result of your conduct.
This indemnity is reduced to the extent the loss was caused by Allure's own negligence.
14. First aid, emergencies and incident reporting
- Each event has a first-aid arrangement and an emergency plan. Ask a host if you need help.
- You consent to a host, safety staff or venue staff arranging first aid, calling an ambulance, or arranging medical treatment for you in an emergency if you cannot consent at the time. You are responsible for the cost of any ambulance or medical treatment.
- If you are injured, or witness an injury or a serious incident, tell a host before you leave so that it can be recorded. We keep an incident register and will cooperate with SafeWork NSW and any other authority as required.
15. Health and safety generally
Allure has obligations under the Work Health and Safety Act 2011 (NSW) to those affected by our events, including attendees and workers. You must:
- take reasonable care for your own safety and not put others at risk;
- use play equipment only as intended and only as directed;
- not bring glass, weapons, illegal drugs or recording devices into an event;
- keep areas clear and report hazards or spills to a host; and
- follow all safety signage and directions.
16. Governing law
These Event Terms are governed by the law of New South Wales. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
17. Your acknowledgement
By obtaining a ticket, place or RSVP for an Allure event, and again by checking in, you confirm that:
- you are a current Allure member aged 18 or over;
- you have read and understood these Event Terms, including the risk warning and assumption of risk in clause 8 and the release and limitation of liability in clause 12;
- you have had the opportunity to ask us questions before agreeing;
- you are agreeing freely and are not affected by alcohol or drugs at the time you agree; and
- you understand that Allure is relying on this agreement in allowing you to attend.
